How often our actions go awry because our perceptions are at odds with reality! This book examines the legal issues that arise when we seek to avoid the untoward consequences of an action by claiming that our perception was flawed. We all make mistakes. Some have unfortunate consequences: we might overpay a debt or make an unfavourable contract, or we might be sued or accused of a crime as a result of our mistake. Claims to alleviation on the grounds of (...) mistake are likely to arise wherever the law prescribes a state of mind as a prerequisite for the application of a legal rule. This book asks when the fact that a person made a mistake should entitle them to alleviation. This may involve the intention to enter into a contract or a payment, in which case a person could seek its reversal, or it might involve the intent to commit a tort or crime, in which case they could seek forgiveness for the offence. Farnsworth defines 'alleviating' mistakes as those which entitle a person to relief from untoward consequences of their mistake.There is no general 'law of mistake', and despite their similarities, few discussions of mistake in one setting pause to consider mistakes in other contexts. The goals of fields as disparate as contracts and criminal law are very different: how do these differences affect the treatment of mistakes? Farnsworth sets out a new taxonomy of mistakes. His analysis reveals that over the past century, there has been a remarkable increase in the receptivity of courts and scholars to claims for both reversal and forgiveness- a waxing of alleviating mistakes. ABSTRACT The technological revolution has created enormous opportunities for the provision of affordable, accessible, and flexible mental healthcare. Yet it also creates complexities and ethical challenges. While some of these challenges may be similar to face-to-face care, their nuance in the online milieu is different, as relationships, identities and boundaries in this setting are fluid, and there is an absence of physical presence. In this paper we consider the specific ethical complexities involved in the provision of a social networking intervention (...) for depression and problematic alcohol use involving providers and peers. We present a case in which clinicians encountered a participant who repeatedly expressed suicidal thoughts in this online forum, and reflect on how this situation was managed. In analyzing this case, we use relational ethics—which proposes that interpersonal relationships are the fulcrum for ethical decision-making and action—together with actor-network theory—which highlights the power of technology to transform and mediate social and ethical relationships. Our analysis demonstrates the need to move beyond human-centric approaches, to recognize the role of both human and non-human actors in shaping moral decisions and behavior in the provision of e-mental healthcare. We extend the concept that life is an informational phenomenon, at every level of organisation, from molecules to the global ecological system. According to this thesis: living is information processing, in which memory is maintained by both molecular states and ecological states as well as the more obvious nucleic acid coding; this information processing has one overall function—to perpetuate itself; and the processing method is filtration of, and synthesis of, information at lower levels to appear at higher levels in complex (...) systems . We show how information patterns, are united by the creation of mutual context, generating persistent consequences, to result in ‘functional information’. This constructive process forms arbitrarily large complexes of information, the combined effects of which include the functions of life. Molecules and simple organisms have already been measured in terms of functional information content; we show how quantification may be extended to each level of organisation up to the ecological. In terms of a computer analogy, life is both the data and the program and its biochemical structure is the way the information is embodied. This idea supports the seamless integration of life at all scales with the physical universe. The innovation reported here is essentially to integrate these ideas, basing information on the ‘general definition’ of information, rather than simply the statistics of information, thereby explaining how functional information operates throughout life. In this article, we analyze the intractability of the low-level radioactive waste debate in California through the construction and examination of policy frames and their associated policy narratives. Relying primarily on reports, formal comments, and written correspondence, we reconstruct three policy frames and explore their interaction in the public debate through the policy stories told by the actors. We analyze how policy actors using these policy frames appropriate available information, value scientific input, and respond to uncertainty in technical and regulatory (...) information to create policy stories. These policy frames and their associated policy narratives demonstrate how policy actors differ in their drivers for action, bases for trusting claims, and response to uncertainty. These differences lead to divergent characterizations of the risk of low-level radio-active waste disposal. This analysis provides insight into the dynamics of intractable policy controversies. The study explored the motivations behind Australian wool producers’ intentions regarding mulesing; a surgical procedure that will be voluntarily phased out after 2010, following retailer boycotts led by People for the Ethical Treatment of Animals. Telephone interviews were conducted with 22 West Australian wool producers and consultants to elicit their behavioral, normative and control beliefs about mulesing and alternative methods of breech strike prevention. Results indicate that approximately half the interviewees intend to continue mulesing, despite attitudes toward the act of (...) mulesing being quite negative. This indicates that attitudes alone are unlikely to be good predictors of this goal directed behavior. Most respondents believed mulesing was more effective and involved less cost, time, and effort than the currently available alternatives to prevent breech strike. Further, they felt relatively little social pressure, as they believed few consumers were concerned about mulesing. However, they noted that if consumer sentiment changed they would likely change their practices. Thus, attitudes are likely to be only one of several factors influencing intentions to change farm practices to address societal concerns about animal welfare. Further, mulesing appears to be goal - directed behavior , suggesting that other factors depicted by the Model of Goal-directed Behavior (MGB; Perugini and Bagozzi In: Br J Soc Psychol, 40: 79–98, 2001 ) may be worth exploring in this context. Finally, these results provide insight into how policy makers may influence farmers to change practices in response to societal pressure for improving farm animal welfare. (shrink)

Beginning in 2002, Wells Fargo began opening fraudulent accounts for unsuspecting customers. Stakeholders at every level either participated in, ignored, or tolerated the bank’s behavior that defrauded consumers on a massive scale. These unethical and well-documented schemes spanned more than a decade. Using public sources, this case recounts the events and ethical lapses that unfolded over the multiyear investigation of the Wells Fargo fraudulent accounts scandal and illuminates the general systemic failures of corporate culture and governance, public regulation, (...) and market responses to promote ethical business practices. This case provides the opportunity to consider what means for fostering ethical conduct might exist if a corporation can be big enough and rich enough that civil, criminal, regulatory, and market forces cannot deter unethical corporate practices, and if the market does not punish the corporation for a culture that promotes fraud. This paper uses the friendship and collaboration of Edwin Ray Lankester , zoologist, and Herbert George Wells , novelist and journalist, to challenge the current interpretation of late Victorian concern over degeneration as essentially an intellectual movement with little influence in contemporary debates over social and political problems. Degeneration theory provided for Lankester and Wells the basis both for a personal bond and for an active programme of social and educational reform. I trace the construction of Lankester’s account (...) of degeneration, initially as empirical ‘fact’ and later as ideologically inflected theory, and the reciprocal relationship between this theory and his critique of the British university system. I use Wells’s Outline of history to illustrate the profound influence of Lankester’s degenerationist worldview on Wells’s scientific and socio-political thought. Lankester’s synthesis of his theory and his critique led the two men to reject eugenics as an unscientific and ideologically incompatible solution to the problem of national deterioration. Instead, they campaigned for the reform of scientific education as a means of keeping mankind from physical, intellectual and cultural degeneration. (shrink)

More than two decades after his seminal paper ‘Subjective Well-Being’, Ed Diener wrote that he substituted happiness with well-being to obtain scientific credibility. Are the arguments echoed in positive psychology rigorous enough to justify this substitution? This article focuses on the historical examination of the word happiness, covering the lexical universes of ancient Greek, Latin, and English, seeking to identify the connections between them. We found that arguments for such substitution are sustained by a fragile appreciation of the semantic depth (...) of happiness. Although it favors quantification, the current understanding of well-being obliterates the plurality of the debate about happiness and the recognition of other ideals of life. Thus, we conclude that well-being and happiness are semantically close, but conceptually, metaphysically, and empirically distinct, demanding, as objects, particular investigations. (shrink)

The word ‘existentialism’ has become something of a catchword in religious circles today, and one suspects that it is sometimes a substitute rather than a medium for thought. Most theological teachers must from time to time have received from a pupil an essay in which the words ‘existential’, ‘existentially’ and ‘existentialism’ appear to have been sprinkled from a pepper-pot over an exposition whose meaning would remain unchanged if these words were excised altogether. Nevertheless, usum non tollit abusus, and the following (...) rather unsystematic remarks may perhaps be of some help in elucidating and evaluating a mode of thought and expression which has attracted the interest of some of the more profound, as well as of some of the more superficial, theological and philosophical writers of the present day. Here I add another plank to that defence of ‘utilitarianism as a public philosophy’, focusing on the peculiar role responsibilities of people serving in public capacities. Such ‘public service utilitarianism’ is incumbent not only upon public officials but also upon individuals in their capacities as citizens and voters. There is an undercurrent to be detected in Anselm's record of the meditative experience that issued in the Ontological Argument and, although it points to a profound and perennial problem in the interpretation of religion, this undercurrent has been largely ignored. The Argument, as is well known, moves entirely within the medium of reflective meaning focused on the idea of God and, unlike the cosmological arguments of later theologians, it makes no appeal whatever to a principle of causality or to (...) the discovery of a sufficient reason for finite existence. Anselm seems to have had his own sense of what one may call the unadulterated rationalism of the Argument when, in his own words, he wondered, ‘if perhaps it might be possible to find one single argument that for its proof required no other save itself, and that by itself would suffice to prove that God really exists’. Here we are entirely within that inner chamber of the mind so dear to the Augustinian tradition, a mind from which one is to exclude all thought save that of God. The task of the one who reflects is to penetrate the inner meaning of this thought in order to discover what it implies beyond what is evident on the surface. With such an eminently rational or logical aim occupying the centre of attention, it is quite understandable that the presence of another, and quite opposed, concern should have been overlooked - Anselm's concern, namely, to transcend, as it were, the medium of thought itself, and enter into the presence of God. The reason that this concern introduces a tension in the search for a proof is that the realization of presence would seem to render proof superfluous, while the inference in an argument - especially one moving towards existence – inevitably suggests, in some sense and to some degree, the absence of what is sought for. I offer an account of this portion of his moral psychology of motivation which brings out its subtleties and complexities. I show that he recognizes the importance of internal sanctions as sources of motives to develop and perfect our characters, as well as of motives to do our duty, and I examine (...) in some detail the various ways in which these sanctions give rise to motivating desires and aversions. There is a widespread belief that for their own safety and for the protection of wildlife, cats should be permanently kept indoors. Against this view, I argue that cat guardians have a duty to provide their feline companions with outdoor access. The argument is based on a sophisticated hedonistic account of animal well-being that acknowledges that the performance of species-normal ethological behavior is especially pleasurable. Territorial behavior, which requires outdoor access, is a feline-normal ethological behavior, so when a cat is (...) permanently confined to the indoors, her ability to flourish is impaired. Since cat guardians have a duty not to impair the well-being of their cats, the impairment of cat flourishing via confinement signifies a moral failing. Although some cats assume significant risks and sometimes kill wild animals when roaming outdoors, these important considerations do not imply that all cats should be deprived of the opportunity to access the outdoors. Indeed, they do not, by themselves, imply that any cat should be permanently kept indoors. (shrink)

Weir Mitchell and W.E.B. Du Bois 1 Susan Wells Here are two stories about double consciousness: they will become, eventually, stories about the public sphere: W. E. B. Du Bois formulating the theory of double consciousness, and S. Weir Mitchell presenting Mary Reynolds's case history, an instance of a mental disorder (...) known in the nineteenth century as double consciousness. I will begin with Du Bois's story, by far the most familiar to us: few texts are more central to contemporary rhetoric or cultural studies than the discussion of double consciousness in the opening pages of The Souls of Black Folk. 2 In the theory of double consciousness, Du Bois concentrated his contradictory experiences of scholarship, activism, social isolation, and active cosmopolitanism. Double consciousness was a methodological constraint that enabled Du Bois to build into the structure of The Souls of Black Folk a recognition that the complexity of African American life requires more than one perspective. And double consciousness was also a technique of writing, shaping the ironic and urgent voice of the book, by turns indignant and tender, eloquent and colloquial, a form of double address to both African American and Caucasian readers that allowed Du Bois to be two places at once. Double consciousness therefore controlled both the development and the presentation of The Souls of Black Folk, from the arc of its argument to its formal elements, includingDu Bois's famous use of chapter epigraphs to link canonic poetry with the melodies of the sorrow songs. Like the most relentlessly formal high modernist poem, the book continually enacts in its form not only its informing idea, but the circumstances of its composition and the constraints that shape its reading.The book's initial essay, "Of Our Spiritual Strivings," offers an analysis of double consciousness as it is shaped by three central categories of modernity: temporality, embodiment, and expertise. Double consciousness is located in time, in history; it is placed in a story of the epochal succession [End Page 120] of races, and in the specific history of slavery. Double consciousness emerges as strategically shaping African American responses to the problems of disenfranchisement, poverty, and the denial of civil rights after the suppression of Reconstruction. The historical sections of The Souls of Black Folk, therefore, do not simply rectify the facts, setting the record straight on Reconstruction or Afrocentric scholar and theorist Alexander Crumell. These local arguments all motivate an understanding of consciousness as temporally constituted, so that the work of previous generations can be effective only when it is appropriated in the present. Such appropriation is supported and mediated by the form of the book: Du Bois ends with an invocation to "God the Reader," who alone can ensure that "these crooked marks on a fragile leaf be not indeed THE END" (19).Double consciousness is also connected with embodiment, specifically the embodiment of African Americans, externalized and displaced in two images: blood, which I will discuss later in the essay, and the veil or caul that grants second sight. Like skin color, the caul is an inconsequential physical object invested with enormous symbolic power (8); it is a mark of origins that foretells the future. The "second sight" offered to the Negro is a vision of "two warring ideals," a vision that can barely be supported by "one dark body, whose dogged strength alone keeps it from being torn asunder"(9). At moments in The Souls of Black Folk, the veil is generalized, and becomes a physical barrier between the white world and the world of African American culture; the work of separating these worlds, of rendering them invisible to one another, is staged on the bodies of African Americans. Such a thesis is counter to prevailing trends among contemporary philosophers. All that is about to be maintained is that facts may be regarded as entities, i.e. that it is legitimate and tenable so to regard them; this is much less than saying that they must be so regarded, and that anyone who declined to make use of the category of facts would be mistaken. Yet even so weak a thesis will be viewed askance by many; those who concede its (...) meaningfulness and logical possibility will still, a large proportion of them, dismiss it on other grounds-particularly on the ground of superfluity. A recent surge of research has begun to examine music participation and well-being; however, a particular challenge with this work concerns theorizing around the associated well-being benefits of musical participation. Thus, the current research used Self-Determination Theory to consider the potential associations between basic psychological needs (competence, relatedness, and autonomy), self-determined autonomous motivation, and the perceived benefits to well-being controlling for demographic variables and the musical activity parameters. A sample of 192 Australian residents (17-85, Mage = 36.95), who were currently (...) participating in a musical activity at the time, completed an online questionnaire. Results indicated that females were more likely to perceive benefits to their well-being; and that how important an individual considers music in their life was positively related to perceived well-being. Importantly, the analyses also revealed that the basic needs of competency and relatedness were related to overall perceived well-being as well as specifically social, cognitive, and esteem dimensions of well-being. Autonomous motivation demonstrated significant associations with both an overall well-being score as well as four of five specific well-being subscales measured. Collectively, the findings indicate that Self-Determination Theory offers a useful theoretical framework to understanding the relationship between musical participation and well-being. Further, the pattern of findings reiterates the positive associations between musical participation and one’s psychosocial well-being, with broad implications for people involved in the facilitation of musical activity. ON ITS surface the Theaetetus ends inconclusively. It has even been said to end in failure. Yet this dialogue is exceptionally full of promise. The speakers are singularly well disposed. Two of them are gifted and resemble one another in looks and interests. Inquiry progresses splendidly through most of a long conversation. Although Theaetetus's first two definitions have to be given up, he is in the process led through a meticulous survey of cognition. These and other circumstances are too auspicious (...) for the termination of the dialogue to be taken at face value. The present essay is meant to disclose a partly hidden successful ending. The latter has to be discovered by readers. However the dialogue itself licenses and encourages active interpretation. The last ten pages of discourse contain so many specific clues that the text can be read as a single development ending in an affirmative conclusion. There is indeed a way to construe "true opinion with logos" so it applies to a cognition worthy of the name "epistémé.". (shrink)

An overarching aim of education is the promotion of children's personal well-being. Liberal educationalists also support the promotion of children's personal autonomy as a central educational aim. On some views, such as John White's, these two goals—furthering well-being and cultivating autonomy—can come apart. Our primary aim in this paper is to argue for a species of a stronger view: assuming preferentism as our axiology, we suggest that there is an essential association between the autonomy of our springs of action, such (...) as desires and beliefs, on the one hand, and personal well-being, on the other. If we are right about this link, then we have at our disposal a partial (non-instrumental) validation of the liberal ideal of autonomy. (shrink)

The path of those who would approach the study of Bentham's writings on Evidence has been considerably smoothed by the recent publication of William Twining's work on the evidence theories of Bentham and Wigmore. The material on evidence is now being tackled by the Bentham Project. It presents no easy task. The central core, The Rationale of Judicial Evidence, edited and published by John Stuart Mill in 1827, exists only in the printed version, the MSS from which Mill worked having (...) disappeared. But a substantial body of related material which survives has yet to be thoroughly investigated, though William Twining has made a gallant start. A new edition of the work hitherto known as ‘An Introductory View of the Rationale of Evidence’, first printed in full in the Bowring edition of the Works of Jeremy Bentham is in preparation. The first fruits of this endeavour is that the title of that work as it should appear in due course in the new Collected Works will be Introduction to the Rationale of Evidence: An Introductory View for the Use of Lawyers as well as Non-lawyers, the title in fact given to the work by Bentham. It is intended that what follows should similarly be of use to non-lawyers as well as lawyers. (shrink)

Context: Phenomenology and the enactive approach pose a unique challenge to dream research: during sleep one seems to be relatively disconnected from both world and body. Movement and perception, prerequisites for sensorimotor subjectivity, are restricted; the dreamer’s experience is turned inwards. In cognitive neurosciences, on the other hand, the generally accepted approach holds that dream formation is a direct result of neural activations in the absence of perception, and dreaming is often equated with “delusions.” Problem: Can enactivism and phenomenology account (...) for the variety of dream experiences? What kinds of experiential and empirical approaches are required in order to probe into dreaming subjectivity? Investigating qualities of perception, sensation, and embodiment in dreams, as well as the relationship between the dream-world and waking-world requires a step away from a delusional or altered-state framework of dream formation and a step toward an enactive integrative approach. Method: In this article, we will focus on the “depth” of dream experiences, i.e., what is possible in the dream state. Our article is divided into two parts: a theoretical framework for approaching dreaming from an enactive cognition standpoint; and discussion of the role and strategies for experimentation on dreaming. Based on phenomenology and theories of enactivism, we will argue for the primacy of subjectivity and imagination in the formation of lived experience. Results: We propose that neurophenomenology of dreaming is a nascent discipline that requires rethinking the relative role of third-, first- and second-person methodologies, and that a paradigm shift is required in order to investigate dreaming as a phenomenon on a continuum of conscious phenomena as opposed to a break from or an alteration of consciousness. Implications: Dream science, as part of the larger enterprise of consciousness and subjectivity studies, can be included in the enactive framework. This implies that dream experiences are neither passively lived nor functionally disconnected from dreamers’ world and body. We propose the basis and some concrete strategies for an empirical enactive neurophenomenology of dreaming. We conclude that investigating dream experiences can illuminate qualities of subjective perception and relation to the world, and thus challenge the traditional subject-object juxtaposition.
